1. Acceptance of Terms

Welcome to Airgas Inc. ("Company", "we", "us", or "our"). By accessing or using our websites, submitting inquiry forms, requesting quotes, renting equipment, or subscribing to our text messaging services, you ("Customer", "User", or "Subscriber") agree to be bound by these Terms of Service ("Terms"). If you are accepting these Terms on behalf of a corporate entity, you represent that you possess legal authorization to bind that entity.

2. Commercial Accounts, Orders & Pricing

All product quotes, industrial gas pricing, and delivery estimates are subject to verification and credit approval by Airgas Inc.:

• Quotations: Price quotes provided via the online portal remain valid for 30 calendar days unless specified otherwise in writing.
• Order Acceptance: Order submission does not constitute final binding acceptance. Orders are confirmed upon official order acknowledgment or dispatch from an Airgas distribution center.
• Purity & Technical Standards: Gas purities, dew point metrics, and mixture tolerances are guaranteed strictly according to published Safety Data Sheets (SDS) and technical certificates of analysis.

3. Cylinder Possession, Rentals & Safety Compliance

High-pressure cylinders, liquid dewars, tube trailers, and microbulk tanks supplied by Airgas remain the exclusive property of Airgas Inc. unless sold under explicit bill-of-sale terms:

• Demurrage & Rental Charges: Customers are subject to daily or monthly cylinder demurrage/rental fees for all cylinders remaining in their possession beyond the agreed rental period.
• Cylinder Return: Empty cylinders must be returned in good working condition with valves closed and safety caps securely attached in accordance with DOT guidelines.
• Hazardous Materials Safety: Customers are strictly responsible for adhering to OSHA, NFPA, and DOT standards regarding proper storage, handling, ventilation, and usage of compressed and cryogenic gases on their site.

5. Delivery, Freight & Title

Delivery dates provided are estimates. Airgas Inc. is not liable for delivery delays resulting from acts of God, extreme weather conditions, traffic disruptions, transport shortages, or hazardous material transit restrictions. Title and risk of loss for consumable gas contents transfer to the customer upon physical delivery or offloading at the designated customer facility.

6. Warranties & Disclaimers

Except as expressly set forth herein, all products, gases, equipment, and online tools are provided "AS IS" and "AS AVAILABLE." Airgas Inc. disclaims all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Airgas Inc. shall not be liable for any indirect, incidental, consequential, special, or punitive damages (including loss of profits, downtime, or production stoppage) arising out of or related to product delivery, gas usage, or website access, even if advised of the possibility of such damages.

8. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be instituted exclusively in state or federal courts located in Philadelphia County, Pennsylvania.
